TERMS & CONDITIONS

Article 1: Object

These General Terms and Conditions (the “Terms”) define the access and use of the Circa ’99 website and the contractual framework for the sale of products (merchandise), musical works, or digital content. By browsing or placing an order, the Customer explicitly accepts these Terms without reservation.

 

Article 2: Intellectual Property

All content on this website (including but not limited to: sound recordings, musical compositions, logos, graphics, photos, videos, and source code) is the exclusive property of SAS CIRCA ’99 or its partners.

  • Protection: This content is protected by the Intellectual Property Code and international copyright laws.
  • Prohibition: Any reproduction, extraction, modification, or commercial exploitation, in whole or in part, is strictly prohibited without prior written consent from the Director of Publication.

 

Article 3: Online Purchases (Merch & Music)

  • Price: All prices are expressed in EURO (€) and include VAT where applicable, excluding shipping fees.
  • Availability: Product selection is valid while stocks last. CIRCA ’99 cannot be held liable for the non-availability of a product.
  • Delivery: Orders are sent to the address indicated in the order form. CIRCA ’99 declines any liability for delays or loss caused by postal services after the goods have been shipped.
  • Right of Withdrawal: In accordance with consumer law, the Customer has 14 days to return physical items (merch) in their original condition.
    • Exception: Digital downloads and unsealed products are non-refundable once access or delivery has been initiated.

 

Article 4: Liability

CIRCA ’99 strives to ensure website availability but cannot be held liable for technical interruptions, bugs, or damages resulting from fraudulent intrusion by a third party. The website contains links to third-party platforms (Spotify, Bandcamp, etc.); CIRCA ’99 has no control over these sites and declines any liability for their content.

 

Article 5: Force Majeure

CIRCA ’99 shall not be held liable if the execution of any obligation is prevented or delayed by a case of force majeure (e.g., postal strikes, natural disasters, epidemics, or general network failures).

 

Article 6: Applicable Law and Jurisdiction

French law is applicable. In the event of a dispute, and failing an amicable settlement, jurisdiction is exclusively granted to the courts of the company’s registered office (RCS of Romans).

 

Article 7: Modifications

CIRCA ’99 reserves the right to modify these Terms at any time. The Terms in force at the time of browsing or ordering shall apply.
